DECREE OF THE MINISTER OF INDUSTRY AND TRADE
NO. 492/MPP/Kep/8/2004

CONCERNING
THE APPOINTMENT OF SURVEYORS TO SURVEY THE IMPORT OF NON-NEW CAPITAL GOODS

THE MINISTER OF INDUSTRY AND TRADE,

Considering:

• a. that in the framework of implementing the provisions in Article 1 point 6 and Article 9 of Decree of the Minister of Industry and Trade No. 756/MPP/Kep/12/2003 on the import of non-new capital goods, it is necessary to appoint surveyors to survey the import of the non-new capital goods;
• b. that in relation thereto, a decree of the Minister of Industry and Trade needs to be issued;

In view of:

• 1. Presidential Decree No. 228/M/2001 (BN No. 6650 pages 29A - 30A) on the establishment of the Mutual Cooperation Cabinet;
• 2. Presidential Decree No. 102/2001 on the status, tasks, functions, authority, organizational structures and working arrangements of ministries;
• 3. Presidential Decree No. 109/2001 on first-echelon organizational units and tasks of ministries;
• 4. Decree of the Minister of Industry and Trade No. 86/MPP/Kep/3/2001 on the organization and working arrangement of the Ministry of Industry and Trade;
• 5. Decree of the Minister of Industry and Trade No. 756/MPP/Kep/12/2003 (BN No. 7017 pages 9A - 14A) on the import of non-new capital goods;

DECIDES:

To stipulate:

FIRST:

To appoint

• 1. PT Surveyor Indonesia; and
• 2. PT Superintending Company of Indonesia (PT Persero SUCOFINDO);

as surveyors executing verification and technical surveillance of non-new capital goods to be imported.

SECOND:

The surveyor as meant in Dictum FIRST shall have the following tasks:

• 1. surveying the import of non-new capital goods in countries of origin where the goods are loaded;
• 2. issuing Certificate of Inspection as a result of the survey as meant in point 1 certifying that the imported non-new capital goods remain feasible to use and recondition for re-functioning, are not scrap as well as providing information on their technical specifications.

THIRD:

The survey as meant in Dictum SECOND shall be applied to non-new capital goods subsumed into Tariff Headings HS 82, 84, 85, 86, 87, 88, 89 and 9009, except the prohibited goods as contained in Attachment I of Decree of the Minister of Industry and Trade No. 756/MPP/Kep/12/2003 on the import of non-new capital goods.

FOURTH:

In executing the survey of the import of non-new capital goods, the surveyor can collect fee of service for service rendered to the importers of the non-new capital goods, with the amount adjusted to the principle of benefit.

FIFTH:

All costs arising from the implementation of this decree shall be borne by the surveyors as meant in Dictum FIRST.

SIXTH:

Technical provisions related to the implementation of this decree shall be stipulated by the Director General of Foreign Trade of the Ministry of Industry and Trade.

SEVENTH:

The appointment of the surveyors as meant in Dictum FIRST shall apply as from the date of stipulation of this decree and come into an end on December 31, 2005 with the provision that it shall not abolish the authority of the Minister of Industry and Trade to revoke, replace and/or supplement the appointment of surveyor to survey the import of non-new capital goods.

EIGHTH:

The decree shall come into force as from the date of stipulation.
